This agreement, between you and Boomerskids, a division of Madeleine's Closet, Inc. covers your participation in an open term promotion with Boomerskids on your website in exchange for payment based on the terms and conditions set forth below. Boomerskids will make available to participants in this program graphical images files and/or text links promoting the Boomerskids website upon review , approval & site acceptance by Boomerskids, following submission of site review information on previous page. 1) This agreement will commence on the date your application request to join the Boomerskids program is accepted by Boomerskids and you accept the agreement terms stated herein by publishing our link URL as defined. This agreement will continue unless terminated by either party. Once accepted to the program, you may copy one or more images/text links for posting on your website. Placement of the links on your home page or other pages will be at your discretion. (Please note that we will reject any website that contains pornographic or hateful content, or does not satisfy acceptable commercial or aesthetic standards.) 2) Boomerskids will furnish you - our affiliate, with a specialized URL to link your site to ours and allow Boomerskids to track click-thru's from your site to ours. Plus, we will assign you a 2nd URL that allows you to log in to the Yahoo!Store tracking program and view your account information including click through activity, and sales and commissions generated. 3) You will be paid a 10% comission on any sales generated through a click-thru from your site to Boomerskids. This commission is based on the product sales total and will not apply to shipping or tax charges generated. Invalid or cancelled transactions will not be subject to commission. 4) Boomerskids grants their affiliates a non-exclusive right to etablish a hypertext link to the Boomerskids website, and use in connection with establishing that line, specified text or graphic image files for the purpose described in this agreement: provided you will not add, subtract or in any way alter or edit any image or make any use whatsoever of any image or other element of Boomerskids intellectual property other than for the purposes of: and as contemplated by this agreement. 5) Any and all customers that come through a link from an affiliate is deemed to be a customer of Boomerskids and will be handled in accordance with Boomerskids site, including but not limited to avaliability, pricing and shipping policy details as determined by Boomerskids and Madeleine's Closet, Inc. Furthermore Boomerskids is not responsible for any representations Affiliate makes which conflict with Boomerskids policies and Boomerskids can not be held liable for any consequences of site/ service interuptions. 6)Terms of this agreement may be amended with the approval of both parties. Agreeement is in force until cancelled or terminated by either party. Acknowledgement and Acceptance of the Terms: By placing the assigned, specific links and graphic image files on your site - at which time affiliate program commences, Affiliate has agreed to above aforementioned terms and has willingly joined in a revenue sharing program with Boomerskids. |
